Frequently Asked Questions
Is it mandatory to provide insurance for a temporary or daily worker?
Yes. From the first day of work—regardless of whether the position is full-time, part-time, temporary, or for specific services—every employee must be insured.
This requirement is set forth in the Occupational Hazards Act (Law 6727), the Labor Code (Law 2 of 1943), and the Occupational Health Regulations (Executive Decree 39408-MTSS)
What happens if I don't insure my employees?
You are exposing your company to legal penalties, business closures, and civil lawsuits.
What is an occupational hazard?
Article 195 of the Labor Code defines it as accidents and illnesses that befall workers in the course of or as a result of the work they perform in a subordinate and paid capacity, as well as the aggravation or recurrence of these risks.
What is a workplace accident?
Article 196 of the Labor Code defines a work-related accident as any accident that befalls a worker as a result of the work he or she is performing or as a consequence thereof, during the time the worker remains under the direction and supervision of the employer or the employer’s representatives. This includes accidents that occur while carrying out the employer’s orders or while performing a service under the employer’s authority, even if the accident takes place outside the workplace or outside regular working hours.
What risks are not covered?
Article 199 of the Labor Code states that the following circumstances do not constitute occupational hazards:
– Those caused intentionally or as a result of a painful incident involving the worker.
– Those resulting from the employee’s intoxication or the use of drugs, narcotics, tranquilizers, or stimulants.
Can I pay for insurance in installments?
Yes, depending on the program, we offer options for paying in installments every six months or every quarter using various payment methods.
My housekeeper is insured through the CCSS. Do I also need to insure her for workplace injuries?
Yes, every worker must be insured by both the CCSS and the Occupational Risk Insurance program, since they provide different types of coverage.
The CCSS provides coverage for health care, pensions, maternity leave, and sick leave due to common illnesses, while the Occupational Risk Program covers work-related accidents, occupational diseases, medical care resulting from occupational risks, and compensation for disability or work-related death.
